The lawyers of the Estates and Trusts practice group at Maynard Cooper have a comprehensive estate and business planning practice, which provides sophisticated will and trust drafting; income, estate and gift tax planning; charitable planning; insurance and employee benefit planning; and a wide variety of creative wealth transfer techniques. We also regularly assist both individual and corporate fiduciaries with all aspects of estate and trust administration. We currently serve as the primary outside counsel for the corporate and personal trust department of Regions Bank. An important component of our estate planning practice has been the representation of family businesses, including planning for both their current operation and their future ownership and management. Our estate planning clients include the chief executives of some of Alabama's largest corporations, as well as numerous owners of closely-held businesses.
Estate, Trust and Fiduciary Litigation
Fiduciary litigation represents a highly specialized practice area that in significant respects is distinct from other types of disputes. Accordingly, Maynard, Cooper & Gale's fiduciary litigation group takes a multi-disciplinary approach, bringing to bear both the firm's depth of expertise in all areas of gift and estate tax, estate planning and trust and estate administration as well as the firm's extensive and broad-ranging experience in traditional litigation and pre-litigation dispute resolution. This melding of multiple substantive areas of expertise allows us to represent our clients effectively in every aspect of their fiduciary litigation needs.
Our fiduciary litigation attorneys regularly represent bank trust departments and trust companies, as well as individual executors, administrators, trustees and other fiduciaries and beneficiaries. We handle litigation ranging from claims of breach of fiduciary duty to will contests to disputes involving estate or trust administration. We also have extensive experience in arbitration and mediation as alternatives to civil litigation. Finally, we review and make recommendations regarding our fiduciary clients' practices and procedures and counsel them on methods to minimize the risk of litigation.
